Land Disturbance Permit RequirementsSEDIMENT IS THE ONE OF THE UNITED STATES LARGEST POLLUTANTS. HELP STOP IT BEFORE IT REACHES OUR STREAMS!Effective February 27, 2004 Fayette County’s Soil Erosion and Sedimentation Control Ordinance was revised to comply with Federal and State mandated changes. Incorporation of the changes is required to retain the County’s certification as a “Local Issuing Authority”. Key provisions of the new ordinance are as follows: Erosion and Sediment Control Plan (ESCP) Requirements An approved Erosion and Sediment Control Plan is required for all projects that meet one of the following criteria:
The Stormwater Management Department will have 14 days to review the ESCP. A master ESCP, inclusive of all building lots, is required for all new subdivisions. This will alleviate the need for lot-specific plans within these developments. Disturbed Acre Fee Permit applicants shall pay the County a fee of $40 per acre of land disturbed and pay the State Environmental Protection Division a fee of $40 per acre of land disturbed. The proposed disturbed area shall be provided by the applicant on the ESCP and rounded to the nearest 1/10th acre. Fees will not be prorated below $40.
